FACTS

The claimants operated a mill whose crankshaft broke, stopping the mill's operation entirely. They engaged the defendants, common carriers, to transport the broken shaft to an engineering firm to serve as a pattern for manufacturing a new one. The defendants were told only that the article was a broken mill shaft, not that the mill would remain completely idle until its return. The carrier delayed delivery well beyond what was reasonable, and the mill remained idle for several extra days as a result. The claimants sued for the profits lost during this additional delay.

ANALYSIS
  • The court held that recoverable damages are limited to loss arising naturally, in the usual course of things, from the breach itself, or loss reasonably within both parties' contemplation, as a probable result of the breach, at the time of contracting.

JUDGEMENT
