Facts

A schoolmaster who had taught at an established grammar school in Gloucester left his position and opened a new, rival school right next door, charging much lower fees than his former school. Because the new master was popular with students and his fees were far cheaper, a large number of students left the old school to join the new one, causing the old school significant financial loss. The old school sued the former teacher for the resulting damages.

Issues
  1. Can the plaintiff school recover damages for the financial loss caused by the defendant's rival school?
  2. Does setting up lawful competition, even one intended to draw students away, infringe any legal right of the plaintiff?
Analysis
  • No person has an exclusive legal right to a monopoly over students, customers, or business.
  • Setting up a lawful, competing school is not, by itself, an infringement of any legal right, however much financial harm it causes to a rival.
  • The court distinguished between actual loss (damnum) and legal injury (injuria) — here, only the former existed.
Judgement

The court held that the defendant was not liable. Although the plaintiff school undoubtedly suffered real financial loss, no legal right of theirs had been infringed — there is no right in law to be free from lawful competition, however damaging.

Conclusion

This is the earliest recorded illustration of damnum sine injuria — real damage without legal injury. It established the enduring principle that lawful competition, even competition specifically intended to hurt a rival, is not actionable in tort, because no one has a legal right to be shielded from it.
