Frustration of Contract —

Frustration of contract is the discharge of a contract by operation of law, when an event after the contract is made — through no fault of either party — makes performance impossible or unlawful.

It is governed by Section 56 of the Indian Contract Act, and unlike breach, it makes the contract void automatically — neither party has a choice about it.

Real-life example

A wedding hall is booked months in advance, but it accidentally burns down three weeks before the event, with no fault on either side.

Where you'll come across this

One of the most heavily tested topics in this unit — appears as both a short-answer definition and a full problem question describing a destroyed subject matter.

Common mix-up

Frustration is not the same as a contract simply becoming unprofitable or more expensive to perform — courts have repeatedly held that mere hardship is not impossibility.
