Facts

At the request of the Collector of a district, Durga Prasad constructed a number of shops in a market at his own expense. Some time after these shops were built and occupied by various shopkeepers, several of those shopkeepers — including the defendant, Baldeo — promised Durga Prasad that they would pay him a commission on articles they sold through their shops, in recognition of the benefit his construction had brought them. When the shopkeepers later refused to pay this promised commission, Durga Prasad sued to enforce the promise.

Analysis

• The court closely examined Section 2(d)'s requirement that consideration must be furnished "at the desire of the promisor" — the critical question was whose desire actually prompted Durga Prasad's original act of building the shops.

• The court found that Durga Prasad built the shops because the Collector asked him to, as part of developing the market for public benefit — not because any of the shopkeepers who later occupied those shops had asked him to build them.

• Since the shopkeepers themselves never requested the construction, their later promise to pay commission could not be legally supported by an act that was, from their perspective, purely voluntary and unrequested — it was, at most, past generosity on Durga Prasad's part toward the market generally, not something done at their desire.

Judgement
