Known simply as Clayton's Case, this old banking dispute is the direct ancestor of Section 61's "chronological rule" for appropriation of payments in a running account.

FACTS

Clayton held a running current account with the banking partnership Devaynes, Dawes, Noble & Co. One of the partners, William Devaynes, died in 1809. At that date, the bank owed Clayton £1,717 on the account. After Devaynes' death, Clayton continued to deposit and withdraw money through the same account with the surviving partners, and over time the surviving partners paid Clayton sums exceeding the £1,717 that had been owing at the date of Devaynes' death.

ANALYSIS
  • In a running account with no appropriation by either party, the court treats it as one blended fund rather than a set of separate, isolated debts.

JUDGEMENT

The court held that the payments made by the surviving partners after Devaynes' death, applied in chronological order, had already discharged the £1,717 owed at his death. Devaynes' estate was therefore not liable to Clayton for that sum.

CONCLUSION

Clayton's Case gives Section 61 its underlying logic: when nobody appropriates a payment, the law does not leave the question open — it presumes the earliest debt is paid off first. Students should remember this as the fallback rule that only applies after the debtor's right (Section 59) and the creditor's right (Section 60) have both gone unused.
