This is the case every Indian matrimonial cruelty argument still has to reckon with — it fixed both the standard of proof and the very meaning of "cruelty" under Hindu law.

Facts

The husband sought judicial separation from his wife on the ground of cruelty, alleging that she had used insulting and abusive language toward him, humiliated him in front of others, and torn up his academic degree certificates in anger. The wife denied the allegations. A key complication was that the husband had continued to live and have marital relations with the wife for some time even after the alleged acts of cruelty.

Analysis
  • The Supreme Court held that matrimonial cases are civil proceedings, and cruelty must be proved on the ordinary civil standard of preponderance of probabilities, not the criminal standard of proof beyond reasonable doubt.

Judgement

Applying this standard, the Supreme Court found that the husband had proved cruelty on the facts, and that any earlier condonation stood revived by the wife's continuing conduct. The Court granted a decree of judicial separation in the husband's favour.
