FACTS

A man threatened to commit suicide unless his wife and son executed a release deed of certain properties in favour of his brother. Under this pressure, the wife and son executed the deed. Its validity was later challenged on the ground of coercion.

ISSUES

Whether a threat to commit suicide amounts to "coercion" under Section 15, given that Section 15 requires an act forbidden by the Penal Code.

ANALYSIS
  • Section 15 requires the coercive act or threat to be an act forbidden by the Penal Code, or unlawful detention of property.
  • At the time, attempting suicide was itself an offence under the Indian Penal Code, so a threat to commit it fell within Section 15's scope.
  • The court held this still amounted to coercion, since the clear intention was to compel the wife and son to execute the deed through fear.
  • This established that coercion is not limited to threats made directly against the contracting party's own person or property.
JUDGEMENT

The Madras High Court held that the threat of suicide amounted to coercion under Section 15, making the release deed voidable.

CONCLUSION

Chikham Amiraju v. Chikham Seshamma broadened coercion to include threats of self-harm intended to compel another to contract, and remains the leading illustration of coercion via a suicide threat.

Chikham Amiraju v.
