FACTS

Bridges, a customer, found a small parcel containing banknotes lying on the floor of the public part of Hawkesworth's shop. He handed it to Hawkesworth, asking him to keep it in case the true owner came looking for it, leaving his own details in case no one claimed it. After several years passed with no owner coming forward, Bridges asked for the notes back, but Hawkesworth refused, claiming they belonged to him because they were found on his premises.

ANALYSIS
  • The court found that the shopkeeper had never had any knowledge of, or exercised any custody over, the notes before they were found by Bridges.
