Bradford Corporation relied on underground water that percolated, in undefined channels, through neighbouring land before reaching the town's reservoir. The defendant, Pickles, owned part of that land. In a dispute with the Corporation, and by his own admission wanting to force it to buy his land at his price, Pickles sank a shaft on his own property specifically to intercept and divert the underground water, seriously affecting Bradford's water supply. The Corporation sued for an injunction, alleging the sole purpose of the excavation was to injure it.
