Facts

The husband alleged that his wife had deserted him after she left for her father's house during a period of illness in the family and did not return. The wife's side of the story was more complicated: the husband himself had been involved with another woman, and the wife later expressed willingness to return to the matrimonial home, but the husband refused to receive her back.

Analysis
  • The Supreme Court laid down that desertion requires two elements on the part of the deserting spouse: the factum of separation, and the animus deserendi — a genuine intention to permanently end the cohabitation — and correspondingly, an absence of consent and of any conduct causing the separation on the part of the deserted spouse.

Judgement

On the facts, the Supreme Court held that desertion by the wife was not established as a continuing offence, given the husband's own conduct and his unreasonable refusal to accept her back when she showed willingness to return. The husband's claim of desertion failed.
