Facts

Bhim Singh, an MLA of the Jammu & Kashmir Legislative Assembly, had obtained a High Court stay on his suspension from the Assembly and was travelling from Jammu to Srinagar to attend an important budget session, where a crucial vote was scheduled. On the night of 9–10 September 1985, he was arrested by the police on an allegation of delivering an inflammatory speech, and was deliberately kept in custody — without being produced before a Magistrate as required — so that he would miss the Assembly session and be unable to vote. He was eventually released on bail on 16 September 1985. His wife filed a writ of habeas corpus before the Supreme Court challenging the illegal detention.
