Bailee —

A bailee is a person to whom goods are delivered, or who takes goods into custody, for a purpose, on the understanding that they will be returned once that purpose is fulfilled. Section 71 treats a finder of lost goods as a bailee, even though no goods were ever voluntarily "delivered" to them.

REAL-LIFE EXAMPLE

Someone who finds a lost phone and keeps it safely while trying to trace the owner is a bailee — they must take reasonable care of it, and cannot use it for their own purposes.

WHERE YOU'LL COME ACROSS THIS

Bailment itself is a separate chapter of the Act (Sections 148–171), but Section 71's finder-of-goods rule is the one place this unit borrows directly from it.

COMMON MIX-UP

Being a bailee never confers ownership. A finder who takes goods into custody remains a bailee with duties and only a limited lien — they cannot treat unclaimed goods as their own outside the narrow sale conditions of Section 169, no matter how long the true owner stays untraced.
