Bail means being allowed to stay out of jail while your court case is still going on — usually by giving the court a promise, or sometimes money, that you will come back for your hearings.
Ravi was arrested after a fight broke out outside his shop. The police took him to the station and booked him under a criminal charge. The next morning, his lawyer filed a bail application before the local magistrate. After hearing both sides, the judge granted bail — Ravi could go home, but he had to sign a bond promising to attend every court date until the case was decided. If he missed a hearing without a valid reason, the bail could be cancelled and he could be sent back into custody.
Bail comes up right after an arrest, usually within the first 24 hours, when the accused is produced before a magistrate. It's one of the most common early-stage court processes in criminal law, and something almost every criminal defence lawyer handles regularly. Bail can be granted by the police themselves for minor offences, or it may require an application to a magistrate or sessions court for more serious charges. Whether bail is granted often depends on the nature of the offence, the risk of the accused fleeing, and whether there's a chance of tampering with evidence or witnesses.
People often confuse bail with parole. Bail is granted before or during a trial, while the case is still being decided. Parole, on the other hand, is granted after a person has already been convicted and has served part of their sentence in prison — it's an early, conditional release, not a pre-trial one. Another common confusion is between bail and acquittal — getting bail does not mean the case is over or that the person is found innocent; the trial still continues.
