Amardeep Singh v. Harveen Kaur (2017)

A couple with nothing left to fight about still had to wait six extra months before their divorce could be finalised — until the Supreme Court decided that rule shouldn't apply when reconciliation is already a lost cause.

Facts

The parties had been living separately for a long period, had already resolved all ancillary disputes — alimony, custody, and property — through mutual settlement, and jointly sought a waiver of the mandatory six-month waiting period between the two motions under Section 13-B(2), arguing that there was no realistic possibility of reconciliation and that waiting further would only prolong their distress.

Issues
  1. Is the minimum six-month period between the first and second motions under Section 13-B(2) mandatory, or merely directory?

  2. Can a court other than the Supreme Court, exercising its ordinary jurisdiction, waive this period without needing recourse to Article 142?

Analysis
  • The Supreme Court examined the underlying purpose of the six-month gap — to give a genuine opportunity for reconciliation — and held that where this purpose has already, and clearly, become impossible to achieve, rigidly enforcing the period would serve no real function.

  • The Court held the period under Section 13-B(2) to be directory, not mandatory, and therefore capable of being waived by the court hearing the matter itself, without needing the case to be escalated to the Supreme Court for relief under Article 142.

  • The Court laid down guiding conditions for such a waiver — the statutory minimum separation period has genuinely been completed, all ancillary issues have been settled, and there is no likelihood whatsoever of the parties reconciling.

Judgement

The Supreme Court allowed the waiver of the six-month waiting period in this case and clarified that trial courts across the country may similarly waive it whenever the laid-down conditions are satisfied.

Conclusion

Amardeep Singh decentralised the power to waive the Section 13-B(2) cooling-off period, making mutual consent divorce meaningfully faster for genuinely settled couples without requiring special Supreme Court intervention in every case.
