A wartime supply contract that draws the line courts insist on: a bargain that has become expensive to perform is not the same as one that has become impossible.

From 1 October 1937, Alopi Parshad & Sons Ltd. were appointed agents of the Government of India to purchase ghee for the Army. After the Second World War broke out and demand rose sharply, the parties mutually agreed to vary the original agreement, substituting a new, higher rate of remuneration for the agents. When costs rose still further, the agents asked for a further increase and received only a non-binding assurance. They later claimed additional remuneration through arbitration, and the arbitrator awarded them extra payment beyond the mutually modified terms.

- The Supreme Court held that mere hardship, or a rise in the cost of performing an obligation, is not impossibility — a contract does not become frustrated simply because it has become more onerous or less profitable than expected.

The Supreme Court set aside the arbitrator's award. The contract had not become impossible to perform, and the agents were bound by the modified terms already agreed — they were not entitled to the additional payment.

Alopi Parshad is the standard citation for "hardship is not frustration." It also carries a useful secondary lesson connecting back to the previous post: when parties themselves modify a contract by agreement (Section 62), that modified version is what binds them — a party cannot later demand even more by claiming the modified bargain is somehow also too difficult to perform.
